0. Definitions

Subscriber / youAny individual or legal entity that creates an Account or otherwise uses the Service.
AccountThe authentication credentials and profile created by or for a Subscriber to access the Service, which may be associated with individual GitHub accounts or GitHub organizations.
OrganizationA GitHub organization connected to your Account for repository access and billing purposes.
ContentAll data and other materials submitted to or generated through the Service (including data pulled from GitHub repositories, with source code access being optional based on configuration).
FeesThe subscription charges payable for any paid plan, plus applicable taxes.
StripeStripe, Inc., our third-party payment processor that handles billing, invoicing, and payment collection services.
Beta or Early-Access FeaturesService features that are in development, testing, or limited release phases, offered without service level guarantees and subject to modification or withdrawal without notice.
GitHub AppThe Pipetrics application defined by Pipetrics and available as part of the GitHub ecosystem at https://github.com/apps/pipetrics, with all permissions defined on the GitHub page under that link.

1. Company Information

These Terms govern your use of the Service operated by Jakub Różycki, Łokietka 5, 30‑010 Cracow, Poland ("Pipetrics", " we", "us", or "our").

2. Service Description

Pipetrics provides observability services for GitHub Actions, including cost insights and analysis tools. Depending on your configuration, we may analyse your repositories with or without reading source code. Beta or Early‑Access Features are provided "as is", with no SLA guarantees, and may be modified or withdrawn at any time without liability (§ 11). Such features may be included in paid plans but remain subject to these limitations.

3. Acceptance of Terms

By accessing or using the Service you agree to be bound by this Agreement. If you do not agree, do not use the Service.

4. User Accounts and Registration

4.1 Eligibility & Age Restriction

The Service is intended for individuals aged 18 or older. By creating an Account, you represent that you meet this requirement.

4.2 Account Creation – GitHub Only

Accounts are created exclusively through GitHub OAuth. No other sign‑up methods are supported.

4.3 Account Security

You are responsible for securing your GitHub credentials and for all activity performed through your connected GitHub account. Compromise of your GitHub account is deemed compromise of your Service Account.

4.4 Geographic Availability

The Service is offered worldwide, subject to applicable export and sanctions laws (§ 8).

5. Service Plans, Billing & Taxes

5.1 Plans

Free and paid subscription tiers are offered on a monthly billing cycle.

5.2 Prices, Currency & Taxes

All prices are quoted exclusive of VAT, GST and other indirect taxes. Taxes will be added by Stripe where legally required, and you are responsible for any remaining tax obligations. Fees are charged in the currency displayed at checkout.

5.3 Payment Processing & Invoicing

Payments are processed by Stripe. By providing payment information you authorise us to debit Fees plus applicable taxes. Invoices are issued by Stripe and are available through the Stripe customer portal accessible from your Account dashboard.

5.4 Automatic Renewal & Renewal Notice

Paid subscriptions auto‑renew each month after an email reminder sent at least 5 days before the renewal date. You can cancel any time from your billing page or by emailing [email protected]; cancellation takes effect at the end of the current period.

5.5 Refund Policy

First‑cycle subscribers may request a full refund within 7 days of the initial charge if the Service experiences significant performance issues that materially impact functionality. Approved refunds will be processed within 14 business days. All other refunds are at our reasonable discretion.

5.6 Non‑Payment and Account Blocking

If any payment attempt fails or Fees remain unpaid past the due date, we may immediately suspend or block access to your Account until all outstanding amounts are received.

6. Data Collection & Privacy

6.1 GitHub Integration

By installing the GitHub app through your GitHub account into your GitHub organization or private account, you grant us permission to access only the specific repositories selected during installation and their associated GitHub Actions data needed to provide the Service. You are responsible for ensuring you have authority to install the app and connect those repositories.

6.2 Data Retention

Upon Account termination we retain your data for thirty (30) days. To request immediate deletion, email [email protected].

7. Service Level Agreement (SLA)

7.1 Commitment – Paid plans include a 99.9 % monthly uptime target, excluding:

  1. Planned maintenance (24 h notice);
  2. Force Majeure events;
  3. Failures of networks, clouds or third‑party services beyond our direct control.

Beta or Early-Access Features are not covered by this SLA commitment. No monetary or credit remedy is provided for downtime; § 13 (Limitation of Liability) applies.

8. Acceptable Use & Compliance

You agree not to:

We reserve the right to suspend or terminate Accounts that violate this section or adversely affect the Service or other users.

9. User Feedback and Content

Any feedback, suggestions or comments you provide may be used by us without compensation or attribution. You retain no rights to such feedback once submitted.

10. Intellectual Property

The Service and all original content, features and functionality are owned by Jakub Różycki and protected by international copyright, trademark and other laws.

11. Service Modifications & Beta Features

We may modify, suspend or discontinue the Service or any feature. Beta or Early-Access Features are offered without SLA guarantees, may be removed at any time and are provided "as is". For paid feature or pricing changes that materially disadvantage you we will give 30 days' notice and the right to cancel before changes take effect.

12. Account Termination

12.1 Termination by Subscriber

You may terminate your subscription at any time by: (i) using the "Cancel" option in your Account dashboard, (ii) emailing [email protected], (iii) uninstalling the GitHub App from either specific repositories or the entire GitHub organization connected to your Account.

Termination takes effect at the start of your next billing cycle, and Fees already paid for the current billing period are non‑refundable regardless of how the termination is effected.

12.2 Termination by Pipetrics

We may suspend or terminate your Account immediately for breach of this Agreement, fair‑use limits, or non‑payment of Fees.

12.3 Outstanding Fees & Data Export

Termination does not relieve you of unpaid Fees up to the effective date. Upon request within 30 days we will provide a machine‑readable export of your data for a reasonable processing charge.

13. Limitation of Liability

To the fullest extent permitted by law:

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non‑infringement.

15. Governing Law & Jurisdiction

This Agreement is governed by Polish law. Any disputes are subject to the exclusive jurisdiction of the Polish courts.

16. Severability & No Waiver

If any provision is held unenforceable, the remaining provisions remain in force. Failure to enforce any right is not a waiver of that right.

17. Survival

Sections on Intellectual Property, Data Export, Limitation of Liability, Disclaimers, Governing Law, and any payment obligations survive termination.

19. Changes to Terms

We may update these Terms occasionally. Changes become effective 30 days after posting and we will notify you by email. If you object, you may cancel before the effective date; continued use after that date constitutes acceptance.
